Because playgrounds are dynamic environments subject to heavy physical use, environmental exposure, and changing weather, we believe in being completely transparent about what our services, warranties, and liabilities cover.

1. Scope of Inspections & Safety Reports

Our playground inspections are performed by Certified Playground Safety Inspectors (CPSIs) in strict accordance with recognized industry benchmarks, including ASTM International standards and CPSC (Consumer Product Safety Commission) guidelines.

• Snapshot in Time: A safety inspection report, structural audit, or compliance assessment represents the condition of the playground equipment and safety surfacing only at the exact date and time of the inspection.
• Subsequent Changes: Play Grow Inc. cannot guarantee, warrant, or imply that a playground will remain compliant, hazard-free, or safe after our team leaves the site. Environmental factors, intensive public use, structural fatigue, or unauthorized modifications can alter equipment safety instantly.

2. Limited Warranty on Services & Workmanship

We take immense pride in the quality of our labor and technical execution.

• Service & Repairs Warranty: Play Grow Inc. warrants that all structural repairs, component installations, and maintenance services will be performed in a professional, workmanlike manner according to current industry standards. If a defect in our workmanship is identified within ninety (90) days of project completion, we will return to correct the specific issue at no additional labor cost to you.
• Third Party Manufacturers: We source heavy duty commercial parts, chains, swings, slides, and hardware from reputable manufacturers. Any warranties regarding material defects, structural lifespan, or chemical treatments are provided exclusively by the product manufacturers themselves. Play Grow Inc. does not independently warrant third party hardware, but we will happily assist you in processing a manufacturer warranty claim if an issue arises.

3. Exclusion of Implied Warranties

Except for the express limited workmanship warranty stated above, all services, reports, and materials provided by Play Grow Inc. are delivered on an “as-is” and “as-available” basis.

To the maximum extent permitted by Florida state law, Play Grow Inc. disclaims all other warranties, whether express, implied, statutory, or otherwise. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non infringement.

4. Limitation of Liability

Playgrounds require ongoing oversight. Property owners, school administrators, and property managers bear the ultimate responsibility for daily monitoring and supervising play areas.

Under no circumstances shall Play Grow Inc., its owners, officers, or technicians be held liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to:

• Injuries, property damage, or accidents occurring on a play structure after an inspection has been delivered, if the property owner failed to execute recommended safety repairs or failed to restrict access to hazardous areas.
• Equipment failures caused by natural wear and tear, vandalism, improper third party modifications, overloading beyond specified weight capacities, or lack of routine owner maintenance.
• Acts of God or severe Florida weather events, including hurricanes, high winds, lightning strikes, salt air corrosion, or flooding.

In all instances, the maximum aggregate liability of Play Grow Inc. for any claim arising out of or relating to our services shall not exceed the total monetary amount actually paid by the client to Play Grow Inc. for the specific service or project in question.

5. Indemnification

By partnering with us, you agree to indemnify, defend, and hold harmless Play Grow Inc. and its personnel from and against any third-party claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising from your failure to maintain the playground facility, restrict access to known hazards, or provide adequate parental or staff supervision on the premises.
